What is an NIE and why you need one

The NIE — Número de Identificación de Extranjero, is a nine-character fiscal identifier issued by the Spanish Policía Nacional to non-Spanish nationals who interact with the Spanish tax or administrative system. It is not a residency permit, it does not grant you any right to live in Spain, and it does not expire. It is simply the number the Spanish tax office uses to track you, and without one you cannot legally sign a property purchase contract at the notary, open a Spanish bank account in your own name, or pay the transfer tax on a home you have bought.

Every international buyer on the Costa del Sol needs one before completion. You do not need one to view properties, to negotiate a price, or even to sign a reservation contract. You absolutely need one to sign the arras private contract with a 10% deposit, and you cannot complete at the notary without it.

Three ways to apply in 2026

Route one is in-person in Spain. Book an appointment at a Policía Nacional comisaría in Málaga or Marbella, attend with your passport, a completed EX-15 form, and proof of the reason you are applying (a signed reservation contract works), and you will typically receive the NIE within 3–7 working days. This is the fastest route for buyers who are already on the ground in Spain. The fee in 2026 is €9.84.

Route two is through a Spanish consulate in your home country. Every Spanish consulate processes NIE applications, though the process varies significantly between embassies — London, Dublin and Manchester run smoothly; New York, Washington and Sydney have longer backlogs; some smaller consulates require you to apply by post. Allow between two and eight weeks from application to receipt. This route works well for buyers who do not need to travel to Spain before the arras.

Route three is via power of attorney. You grant a limited power of attorney to your Spanish lawyer, notarised in your home country and then apostilled, and the lawyer applies on your behalf. This is the preferred route for buyers who cannot travel and who find their consulate slow or uncooperative. Allow 2–4 weeks once the lawyer has the original PoA in hand. Budget around €400–700 for the power of attorney preparation, notarisation and apostille on top of the NIE fee itself.

When in the buying process should you apply?

Start the NIE application the moment you shortlist Marbella seriously, ideally before you fly out to view properties. The application is free to start even if you do not end up buying, and an NIE in hand removes 2–4 weeks of potential delay between a price being agreed and the arras being signed. The single most common source of deal slippage on the Costa del Sol in 2026 is buyers who waited until an offer was accepted to begin the NIE process.

If you are already in an active negotiation without an NIE, start the application the same day your offer is accepted. Your Spanish lawyer can usually triangulate a consulate-route application with a parallel in-person route when you next visit, and the fastest of the two wins. We have never lost a deal to an NIE delay, but we have had to ask for completion extensions on a handful.

Apply for your NIE before you start viewing properties, delayed NIE applications are the single most common cause of deal slippage on the Costa del Sol.

Mistakes we see most often

Applying at the wrong consulate. Some Spanish consulates only accept applications from residents of specific countries or regions, check the consulate website before booking. Applying without the justification letter. Since 2024 the police and consulates routinely ask for a justification: a signed reservation contract, a letter from your Spanish lawyer, or a purchase intent letter from your estate agent. Not having one will get your application rejected at the counter.

Using a white assignment form (EX-15) instead of the green one. There are two NIE forms in Spanish administrative use and only EX-15 is valid for non-residents applying for property-related reasons. Your lawyer will supply the right one. Finally, and this is specific to Málaga province, do not try to apply without an online cita previa (advance appointment). Walk-in applications have not been accepted at Málaga comisarías since 2023.

Always bring a justification letter and use the correct EX-15 form, incomplete applications are rejected at the counter and cost weeks of delay.

How long does a Spanish NIE number take to get in 2026?+

In-person at a Policía Nacional comisaría in Málaga or Marbella: typically 3–7 working days from appointment to receipt. Through a Spanish consulate in your home country: 2–8 weeks depending on the consulate (London, Dublin and Manchester are the fastest; smaller consulates can be slower). Via power of attorney through your Spanish lawyer: 2–4 weeks once the PoA has been notarised and apostilled. Start the process as early as possible, there is no downside to having an NIE before you find a property.

Do I need an NIE to view properties in Marbella?+

No. You can view properties, negotiate prices, and even sign a small reservation deposit contract without an NIE. What you cannot do without an NIE is sign the binding arras private contract with a 10% deposit, open a Spanish bank account in your own name, pay the transfer tax (ITP), or sign the public deed of sale at the notary. In practice this means you can start house-hunting before applying, but you should begin the NIE application the moment you are seriously considering a specific property.

Does a Spanish NIE number expire?+

No, the NIE number itself never expires. However, the physical certificate issued by the Policía Nacional is sometimes treated by Spanish banks and notaries as only valid for three months from issue. If you applied for your NIE more than three months before completion and your bank or notary raises an issue, you can request a simple renewal letter from the police station that will satisfy both. This does not change the underlying NIE number, only refreshes the paper. Plan to apply for your NIE within six months of expected completion to avoid the question entirely.

How much does a Spanish NIE cost in 2026?+

The official Spanish government fee is €9.84 in 2026, paid at a Spanish bank counter using the Modelo 790 tax form. If you apply through a consulate, expect a processing fee of €10–50 on top depending on the consulate. If you use a Spanish lawyer with a power of attorney, typical all-in cost including the PoA preparation, notarisation, apostille, lawyer time and the NIE fee itself runs to €400–700. In-person applications in Spain are the cheapest route at roughly €10 plus any lawyer time.

Can I use a Spanish NIE for anything other than buying property?+

Yes. Once you have an NIE you can use the same number to open a Spanish bank account, file the non-resident Modelo 210 imputed-income tax return, buy a car, register for utilities in your own name, sign a long-term rental contract, enrol children in Spanish state schools, apply for a Spanish driving licence (if eligible), and appear as party to any Spanish administrative or tax matter. Many buyers apply before purchase and end up using the number for a decade or more. It is a one-time cost that simplifies every subsequent Spanish transaction.
